The DOL's Proposed Worker Classification Rule: What It Means If You Use Contractors

On February 27, 2026, the Department of Labor proposed a new rule that would replace the 2024 independent contractor standard, shifting back toward an "economic reality" test — one that weighs primarily how much control a company has over how, when, and where a worker does their job.

Why this matters if you rely on 1099 workers

Worker classification has been genuinely unstable for the past few years, flipping between administrations and standards. That instability is exactly what creates risk for businesses: a contractor relationship that was compliant under one standard can look misclassified under the next. The proposed rule hasn't been finalized, but it signals where enforcement priorities are likely heading.

Where managed outsourcing sits differently

This is a meaningful distinction worth understanding: when you engage a managed outsourcing or staffing partner, the people doing the work are typically employees of that partner, not your own independent contractors. That's a fundamentally different legal relationship than classifying someone directly as a 1099 worker on your own payroll — the classification risk sits with the vendor's employment structure, not with how you personally direct someone's day-to-day work.

That doesn't mean outsourcing is a blanket shield from every compliance question — vendor relationships have their own rules and need to be structured properly too. But it's a different risk profile than managing a roster of individual contractors directly.
